Cop complains to court of illegal arrest

A police constable from the Bibile Police Station, had complained to the Supreme Court that, Sub Inspector Gunaratne and Officer-in-Charge H. M. F. Anil of the Bible Police Station, had filed a ‘B-report’, against the petitioner T. M. Senaratne of Bibile in the Magistrate’s Court of Bibile, without any basis for doing so.

On the night of June 25, 2002 the petitioner had voluntarily intervened to settle an altercation, between some persons, but unfortunately the petitioner had been charged of causing simple hurt, and charged under section 315 of the Penal Code.

Subsequently the petitioner had been interdicted from service with immediate effect, without granting the petitioner any pay, the petition explained.

An investigation carried out by Sub-Inspector Gunaratne and Inspector H. M. F. Anil had revealed that there was absolutely re evidence against the petitioner, to charge him under the Penal Code.

The petition alleged arbitrary treatment, illegal arrest and illegal detention, by the respondent officers of the Bibile Police Station.

The petitioner claimed damages in Rs. 500,000 for the violation of fundamental rights.

The respondents are Sub-Inspector Gunaratne, Inspector H. M. F. Anil and P. Munasinghe, A. S. P. of the Moneragala Police Station.
