Forced to consume liquor
2nd Lieutenant complains of assault by superiors

A twenty-three-year-old Second Lieutenant of the Gajaba Regiment of the Sri Lanka Army, B. D. L. P. Gunarathne has complained to the Supreme Court in a fundamental rights violation plea, that his superiors forced him to consume alcohol at a party on September 9, 2003. When he refused to take it in excess he was assaulted by his superiors.

The petitioner was hospitalized at the Military Hospital, consequent to the assault. He had passed blood with urine, the petition said.

The petition alleged inhuman treatment and assault by his superiors and requested the court to direct the superior officers of the Gajaba Regiment to transfer him out of their regiment.

Among the respondents are Lt. Senadheera, Captain Kumaratunga and a few others of the Gajaba Regiment.

The Supreme Court on Monday granted leave to proceed with this petition.

The application for interim relief in respect of the transfer, will be supported tomorrow (4).

The petition was supported on Monday by J. C. Weliamuna, appearing with Shantha Jayewardene.

The Bench comprised Justice Dr. Shirani Bandaranayake, Justice P. Edussuriya and Justice Nihal Jayasinghe.
