AG to provide Court with necessary documents

The Attorney General on Friday gave the undertaking to the Court of Appeal that the State will make available to the Court the necessary documents from the Minister of Sports, and the Secretary to the Ministry, in respect of the Writ application filed by H. U. Silva, the former Secretary-General of the National Olympic Committee.

H. U. Silva had challenged the appointment of Chandana Perera and Maxwell de Silva, as the Assistant Treasurer and Secretary General respectively of the National Olympic Committee. He had requested the Court to quash these appointments and to order the Ministry to call for nominations and hold an election, according to the provisions of the constitution of the National Olympic Committee. When the petition was called before the Court, the Deputy Solicitor General, Ms Murthu Fernando said that the State had received only limited documents from the first respondent Minister and the second respondent, the Secretary to the Ministry.

The Court was of the view that further documents from the State were needed to consider the issue of notice on the respondents and the granting of interim relief to the petitioner.

The Deputy Solicitor-General, Murthu Fernando, undertook to furnish further documents by the next date, November 25, 2009.

M. A. Sumanthiran appeared for the petitioner, H. U. Silva, Faiz Mustapha, PC, appeared for the executive committee members of the National Olympic Committee. The Bench comprised, Justice Saththya Hettige (President) and Justice Anil Gooneratne.
