Against directive to shut down transmission of Shakthi TV
MTV files writ application in Court of Appeal

The MTV Channel Pvt. Limited, yesterday filed a writ application in the Court of Appeal, against the decision of the State dated January 4, 2010, to direct the MTV, to shut down the transmission of Shakthi TV on channel 25 in Jaffna and further to handover the channel formally to the Independent Television Network.

The petitioner had requested the Court of Appeal to quash the arbitrary decision taken by the Minister of Media and Mass Communication and a few other respondents.

The petitioner had requested the Court to prohibit the respondents from interfering with the transmission on Channel 25.

The petition said that the petitioner had been transmitting the Shakthi TV with the full knowledge and the consent of the Telecommunication Regulatory Commission. The decision taken by the respondents recently is mala-fide and illegal.

Among the respondents are the Minister of Mass Media and Information, Anura Priyadharshana Yapa, the Secretary to the Ministry, the Telecommunication Regulatory Commission, its Chairman Lalith Weeratunge, the ITN and the Attorney General.

The petition will be supported by Sanjeewa Jayewardene and Sandamali Chandrasekeran instructed by Sudath Perera Associates.
