UNP candidates’ undated letters of
resignation legally valid – Kirielle
Similar letters obtained by JR were accepted by court

Undated resignation letters submitted to the party by all UNP candidates contesting the forthcoming General Election, were legally valid, UNP’s Kandy District Leader, Lakshman Kirialle said yesterday.

Asked if the resignation letters would stand the test in a court of law, he told The Island that it should, because similar letters which the late President J. R. Jayewardene obtained from UNP MP’s after the 1978 constitution was enacted, had been deemed legal.

The UNPers contesting the April 8th parliamentary polls, have addressed their letters of resignation supported by affidavits Kirialle said.

Asked about the validity of the resignation letters, in view of the judgement by a bench headed by the former Chief Justice Sarath N. Silva, permitting UNP MPs to cross over to the government and hold ministerial position, Kirialle said that the two situations were different.

"Unlike the MPs who joined the Mahinda Rajapaksa government, all UNP candidates at the forthcoming parliamentary poll, have submitted advance letters of resignation from the UNP and parliament. By doing so, all of them have acknowledged that the party precedes the individual," Kiriella said.
