Centre for Environmental Justice challenges Colombo Port City EIA in CA

The Centre for Environmental Justice (Guaranteed) Limited yesterday filed a Writ Application in the Court of Appeal against the Environmental Impact Assessment Study done by the China Harbour Engineering for the Port City Colombo.  

The petition wanted the Court to quash the decision in respect of the assessment which, they said, had been done in violation of section 16 of the Coast Conservation Act 57 of 1989.

The fundamental rights of the citizens had not been taken into consideration in carrying out the assessment of the environment impact of the project which had a serious negative effect on the balance of the ecosystem, the petition said. 

The assessment done by the Colombo Port City was bad in law and there had been no proper analysis of effect son the corals, the deep sea and the natural Eco-balance in general, it argued.

The petition has requested the Court of Appeal to order the Sri Lanka Ports Authority and the Director General of Coast Conservation and Coastal Resource Management to take steps to prepare a balanced report and to decide on the issue of granting permission for the assessment report within the provisions of the law. 

The petition will be supported by Ravindranath Dabare appearing with Sumudu Liyanarachchi and Nilmal Wickremasinghe.
