DIG files FR case over alleged unreasonable extension given to senior officer

The Supreme Court yesterday fixed for support on July 27, 2015, the fundamental rights violation petition filed by Deputy Inspector General of Police, Galle S.A.D.S. Gunewardene.

The petitioner has alleged that the extension of service given to Senior DIG, Gamini Navaratne is unreasonable. Navaratne was given an extension on contract.

The extension was decided by the Cabinet of Ministers and not by the National Public Service Commission. An extension of Service on Contract was unreasonable. Had Navaratne been retired on schedule, the petitioner would have got his due promotion as Senior DIG, he contended.

DIG Gunewardene has requested the Supreme Court to cancel the arbitrary extension given to Navaratne and to promote the petitioner in his place.

President's Counsel Uditha Egalahewa appeared for the petitioner.

Faiz Mustapha PC appeared for Gamini Navaratne, a respondent.

Deputy Solicitor General, Rajiv Goonetillake, appeared for the Attorney General.

Among the respondents cited in the petition are the President Maithripala Sirisena, who is also the Minister of Defence and the Cabinet of Ministers.

The Bench comprised, Justice Chandra Ekanayake, Justice Upali Abeyratne and Justice Anil Gooneratne.
