CA issues notice on Motor Traffic Chief Transport Minister

The Court of Appeal yesterday issued notice returnable on Nov. 18, 2015 on the Commissioner General of Motor Traffic, A.H.K. Jagath Chandrasiri, Minister of Transport Nimal Siripala de Silva, the IGP and a few other connected respondents in respect of a Writ Application filed by the Western Province Three wheeler Drivers’ and Owners  Co-operative Society.


The petitioner association wants a Writ of Mandamus to compel the respondents, to implement a mechanism to endorse the driving licences of the drivers engaged in public transport, according to gazette 1848/29 of February 2, 2012.


The petitioner wants the court to direct the authorities to form a fair Review Committee to appoint an authorised officer in terms of the gazette to endorse the licences of three wheelerdrivers. The offender of the regulation should be directed to be prosecuted.


The petition has said that the public has not yet reaped the benefit of the gazette as the authorities have not yet appointed the Regulatory Mechanism to endorse the licences of the drivers.
