SC grants Basil  et al time to file counter objections

The Supreme Court yesterday granted time till June 14, 2015 to petitioners Basil Rajapaksa former Minister of Economic Development, Kithsiri Ranawaka, Director General ‘Divineguma Development Project’, Dr. Nihal Jayatillake, the former Secretary to the Ministry of Economic Development and R. Bandula Thilakasiri, the former Coordinating Secretary of Divineguma to file counter objections.

The respondents, the Director of the Financial Crimes Investigation Division, the IGP, the Cabinet of Ministers and the Attorney General had filed objections to the petition filed by Rajapaksa and the other three petitioners.

They have complained that the FCID unduly questioned them on an allegation of misuse of Divineguma funds and consequently arrested them.

They have alleged arbitrary treatment and a violation of their personal liberty by the respondents. They have asked for a declaration by the court on the issue.

Romesh de Silva, PC appeared with Manohara de Silva, PC, Sanjeewa Jayawardene, PC, M. Alisabry, PC and Sugath Caldera for the petitioners.

Among the instructing attorneys for the petitioners are Athula de Silva, Sanath Wijewardene and Mayomi Ranaweera.

Additional Solicitor General Jayantha Jayasooriya, PC appeared with Deputy Solicitor General, Viraj Dayaratne, Deputy Solicitor General Nerin Pulle and Senior State Counsel, Viveka Siriwardene for the respondents.

The bench comprised Justice Eva Wanasundera, Justice Priyantha Jayawardene and Justice Upali Abeyratne.
