Ruling on DPL immunity on Dec. 8

By Chitra Weerarathne

The District Judge of Colombo T. D. Gunesekera will declare on Dec. 8, 2015 whether Subinay Nandy, the United Nations Resident Coordinator in Sri Lanka, has legal immunity to keep away from the District Court of Colombo.

Subinay Nandy is the defendant in a plaint filed by Dr. Gunadasa Amerasekera, requesting that an order be made that the investigation against Sri Lanka in resolution A/HRC/25/L.I/ Rev. is illegal and that the defendant should apologise for the dishonour caused to the plaintiff and Sri Lanka.

Counsel Kapila Gamage told the court yesterday that if the defendant did not come to court the plaint should be heard ex parte and decided.

Kapila Gamage appeared with Dharshana Gamage.

The aforesaid UNHRC resolution refers to alleged Human Rights violations in Sri Lanka.
