Ex-Defence Secretary’s FR application re-fixed for argument on May 25

The Supreme Court yesterday re-fixed for argument, on May 25, 2016, the fundamental rights violation petition filed by the former Defence Secretary, Gotabhaya Rajapaksa, who has complained to the Court about an imminent arbitrary decision.


The Bench comprised Justice Priyasarth Dep, Justice Priyantha Jayawardene and Justice Upali Abeyratne. Justice Jayawardene has declined to hear the case.


The petitioner has alleged that the FCID questioned him in respect of a baseless allegation pertaining to a decision to let the Avant Guard Company Pvt Limited run a floating armoury, off the shores of Galle and a few other issues.


Other issues include the purchase of fighter jets for the Sri Lanka Air Force during the war, alleged manipulation of shares in Lanka Hospital Private Limited and leasing of air planes for Mihin Lanka.


Among the respondents cited in the petition are the Cabinet sub-committee, the director FCID, the Director CID and the IGP.


President’s Counsel Romesh de Silva appeared with Sugath Caldera for the petitioner Rajapaksa.
