GMOA President prejudged – Counsel

Alleged contempt of Appeal Court:

President of the Government Medical Officers Association Dr. Anuruddha Padeniya yesterday told the Court of Appeal that he was not guilty of the charge of contempt of the Court of Appeal levelled against him. The inquiry against him was fixed for August 2, 2017.

The charge sheet was read out to him and he was given a copy for reference.

The charge sheet said that on April 7, 2017, the GMOA had launched a protest march in Colombo against the Court of Appeal judgement which ordered the Sri Lanka Medical Council to provisionally register the graduates of the South Asian Institute of Technology and Medicine. Subsequent to the protest march the doctor held a meeting in Colombo, where Dr. Padeniya in a public address allegedly insulted the court, the judges and the Attorney General.

The Court of Appeal at an earlier hearing, restrained the President of GMOA from making any more insulting statements about the Court of Appeal. This restraining order is valid till the final determination of the contempt of Court of charge.

Suspect, Dr. Padeniya, was ordered to appear before the Court on May 22, and to show cause as to why he should not be punished for contempt of the Court of Appeal.

President’s Counsel Gamini Marapana took up a preliminary objection to be effect that his client, Dr. Padeniya, had been prejudged by the Court of Appeal to the effect that the court was satisfied that Dr. Padeniya had committed the offence of contempt of the Court of Appeal and that he should be asked to show cause as to why he should not be punished.

Gamini Marapana also said that the Court of Appeal on that day had even ordered the GMOA not to make any further contempt was statements against the court.

Marapana P.C., appeared with Manohara de Silva P.C., Navin Marapana and Ravindranath Dabare for Dr. Padeniya.

Counsel Upul Jayasuriya P.C. appeared with Sandamal Rajapakse for the petitioners Professor Sarath Wijesuriya and Gamini Viyangoda.

Dr. Padeniya had insulted the court.

The Bench comprised Justice Rohini Walgama (President) and Justice S. Thurarirajah.
