Musthapha says LG polls laws cannot be amended retrospectively

Minister of Local Government and Provincial Councils Faiszer Musthapha has, in a letter to the Election Commission, said that the local government election laws can’t be changed with retrospective effect to be applicable the February 10 polls and any amendments thereto will apply to future polls


 "The Election Commission has declared that the Local Authorities Elections (Amendment) Act, No. 16 Of 2017 needs to be changed to solve the issues arising from the 25% female quota. When the Act was amended the views of the Commission as well as the Department were taken into consideration. If there are any issues, the Attorney General should be consulted."


 The Minister has added that the February 10 local government election was held under the Local Authorities Elections Ordinance (Chapter 262) and amendments thereto.


"There is a legal obstacle to changing the laws to be applicable to the February 10 election. If there are any difficulties in electing councillors we will have to make necessary amendments in respect of local government polls to be held in the future.
