Neither the Acting IGP Chandana Wickramaratne nor any other senior police officer had instructed him to produce interdicted High Court Judge Gihan Pilapitiya in court, OIC of the Colombo Crimes Division (CCD,) Nevil de Silva told Nugegoda Additional Magistrate, H.U.K. Pelpola, yesterday. Silva said that he had heard Attorney General Dappula de Livera had asked Acting IGP to produce

Pilapitiya in court as per his instructions given on January 23.

Silva added that policemen attached to the CCD, at present, were not taking steps to record evidence to arrest Pilapitiya.

Silva made this statement when he was asked whether he was aware of the AG’s directive and, if so, what steps were being taken.

Senior State Counsel, Janaka Bandara, representing the AG, requested the court to give him time to consult his seniors and report the progress.

Attorney-at-law, Ali Sabry, representing Pilapitiya, said that the Bar Association of Sri Lanka (BASL) had appointed a committee, comprising six senior presidents counsel, to recommend what steps should be taken under such circumstances. That was done to protect the dignity of the judiciary and the legal profession, he said. Once the recommendations were made, they would have a discussion with the AG to put in place a proper mechanism, Sabry told court.

The Magistrate asked the OIC of the CCD to consult his superiors by February 26 and report to court.
