Stay order on Fonterra extended

By Chitra Weerathne

The Court of Appeal yesterday varied the suspension order issued earlier on Fonterra Products Private Limited, with regard to advertisements and extended the aforesaid varied stay order till Oct. 15, 2013.

The varied stay order said that the Consumer Affairs Authority was compelled to prevent the Fonterra Products Private Limited from including the phrase, "100 per cent free of DCD," in advertisements regarding milk powder imported and distributed by Fonterra. Subject to that variation Fonterra was free to advertise.

A Writ Application had been filed in the Court of Appeal by Saliya Samarasinghe, an architect  by profession, who requested the Court to prohibit Fonterra from advertising that Fonterra milk was ‘100 per cent free of DCD’. The first respondent is the Consumer Affairs Authority.

Counsel Upul Jayasuriya appeared for the petitioner.

Sanjeewa Jayewardene PC, appeared for Fonterra.

Deputy Solicitor General Janak de Silva appeared for the Consumer Affairs Authority.

The Bench comprised Justices S. Sriskandarajah (President) and Malinee Gunerathne.
